CYNGOR CYMUNED LLAN LLYR/LLANYRE COMMUNITY COUNCIL

A meeting of Cyngor Cymuned Llan Llyr/Llanyre Community Council was held at Newbridge-on-Wye Community Centre on Tuesday 15th December, 2015.

 Present:- Councillor S. Powell  (Chairman);

   Councillors Mrs. T. Field, S. Grimwood, G. Lewis, S. Meredith,
   G. Rees, L. Smith and M. Watkins.

 In attendance:- County Councillor W. J. Evans

72/15 APOLOGIES FOR ABSENCE

 Apologies for absence were received from Mr. M. Davies.

73/15 DECLARATIONS OF INTEREST

 Mr. S. Powell declared an interest in Item 76/15 and 79/15 and left the meeting whilst the items were discussed.
 Mr. L. Smith declared an interest in Item 79/15 and left the meeting whilst the item was discussed.

74/15 MINUTES

 The Chairman was authorised to sign as a correct record the Minutes of the meeting held on 17th November, 2015.

75/15 MATTERS ARISING

(a) New A470/Traffic Calming Measures/By-pass (ref. Min. 63/15(a))

An acknowledgement was received stating that a full response would be provided in January.  Councillor Evans reported that he had made enquiries whether the signs could be set to flash 30 mph during the time when they were not 20 mph.  It was confirmed, however, that this was not possible as it was illegal.

(b) Public Toilets, Llanyre (Ref. Min. 63/15(b))

(d) Recycling Sites

Llanyre – paper bin was emptied on 4th December and the glass is half full.
Newbridge-on-Wye – no problems to report.

It was reported that the rubbish bags had also been cleared.

(e) Mid Wales House –Parking (Ref. Min. 63/15(e))

Councillor Evans reported that he had spoken to Mr. A. Knox at County Hall, who had confirmed that he didn’t currently have a member of staff to look in to the matter at present.  Mr. S. Meredith reported that he now had additional photographs which would be delivered to Mr. Knox.

(f) Proposed Llanyre Church/Community Hall (Ref. Min. 63/15(f))

Mr. M. Watkins reported his contact with Mr. R. Cawthorne who said he could not add any more than the information contained in his previous letter, other than, management of the field part of the Recreation Ground may be flexible enough to allow partial or whole grazing of the pasture from time to time, subject to agreement with the Charity Commission.

As regards Village Green status, the hearing by the commons Commissioner in 1973 stated:-

(i) The land in question is unit VG-13 in The Register of Town or Village Greens maintained by the Radnorshire County Council in which no person(s) is/are shown as the owner in Section 4 of the Commons Registration Act 1965;

(ii) Following advertisement and a hearing on the 6th June, 1973 the Commons commissioner was satisfied that the land shown in an “Inclosure Award dated 25th August, 1840” for use as a Recreation Ground and he resolved to direct Radnorshire County Council to Register Llanyre Parish Council as th eland owner order Section 8(2) of the 1965 Act.  The Decidsion statement did not contain any reference to a plan or give description of boundary of the land involved.

The Charity Commissioners Scheme “Llanyre Recreation Ground (524466)” dated 12.02.02 refers only to Allotment 132 (see para 1 of Schedule on page 4) “an Inclosure Award dated 6th October, 1843”.  The said Award shows the Recreation Ground to comprise Allotments 132 and 133 (Pritchard Recreation Ground).

This subject has become convoluted and the following action is proposed:-

(i) An appointment to further view relevant documents in the County Archives has been made for 12 noon on Friday, 8th January.   (appointments are only available on alternate Fridays and the 8th is the first one available)
(ii) A draft letter, subject to any relevations, on the 8th January to be prepared to go to One Voice Wales for guidance.

(g) Proposed New Crèche/Community Facility (Ref. Min. 63/15(g))

It was reported that the Committee were still awaiting confirmation of the outcome of the grant application.

(h) Newbridge-on-Wye and Llanyre Playing Fields (Ref. Min. 63.15(h))

A report of an Inspection of Llanyre Playing Field, which was undertaken on 11th November, 2015, was received from Mr. S. Gealy.   The following low risk defects were reported:-
- Wet through gateways;
- Ownership sign required;
- Repair spring on gate;
- Programme removal of swing;
- ROSPA recommends to build up soil levels around Noughts and Crosses game.

Members received the recommendations and agreed to investigate.  It was, however, felt that it would be beneficial for a Member of the Council to be present when the inspections are undertaken and Mr. L. Smith kindly agreed to be the designated Councillor for a trial period.

(i) Electronic Planning Applications (Ref. Min. 63.15(j))

A response had been received stating that the Council’s concerns would be forwarded to the appropriate Officer.

(j) Account Book (Ref. Min. 70/15)

The Clerk reported that she had posted a copy of the Accounts for the year ended 31st March, 2015 to Mr. B. Price.  No further comment had been received to date.

76/15 PLANNING APPLICATIONS

 Mr. S. Powell and Councillor W. J. Evans left the meeting whilst this item was discussed.  In the absence of the Vice-Chairman, Mr. M. Watkins was appointed Chairman for this item.

 P/2015/0743 – Wern Farm, Llanyre – erection o wind turbine with control box and associated works.   Two letters of objection to the application were received and were taken in to consideration when determining the response. 

The additional information received took the form of linear drawings and photographs showing the siting of the proposed turbine.  However, it was noted that the photographs were taken from a long distance away.  Following a discussion it was proposed by Mr. S. Grimwood and seconded by Mrs. P. Deakin that the Council’s comments made in September were still relevant and the Members had nothing further to add.  All in favour.

 Councillor W. J. Evans returned to the meeting.

 TREE/2015/0041 – Pantyrhiwen, Llanyre – it was RESOLVED – that the Members had no objection to the application, subject to the following conditions:-
 
1. That the application for the 20% reduction on the birch and mature oak be strictly adhered to and
2. The hardwood trees be replaced, in a suitable position, with trees of a similar species.

Proposed by Mr. G. Rees and seconded by Mrs. T. Field.

Mr. S. Powell returned to the meeting.

78/15 CORRESPONDENCE

(a) British Red Cross

A request for financial assistance was received.  RESOLVED – that the request be declined.

(b) One Voice Wales

Correspondence was received outlining details of the of the Draft Local Government (Wales) Bill which had been published for consultation.  This also included consultation on the Welsh Government’s preference for the future map of local government in Wales.  The closing date for responses is 15th February, 2016.

(c) Executive Leader – Community Delivery

Correspondence was received from the Executive Leader regarding the future of Community Delivery within the County. Copy filed with the signed Minutes.

(d) Citizen’s Advice Bureau

A letter of thanks for the Council’s donation was received.

79/15 LLANYRE RECYCLING
 
 Mr. L. Smith and Mr. S. Powell left the meeting whilst these matters were discussed.  In the absence of the Vice-Chairman, Mr. M. Watkins was appointed Chairman for this item.

 The following applications were received:-

 Llanyre Thursday Club – a request for financial assistance towards the costs of organising speakers, outings and social activities was received.  It was noted that they last received a donation in November, 2014.  It was proposed by Mr. S. Grimwood and seconded by Mr. S. Meredith that a donation of £73, being 10% of the amount available, be agreed.  All in favour.

 Carols at the Christmas Tree – a request for financial assistance towards the Christmas Tree Celebrations was received.  It was proposed by Mrs. T. Field and seconded by Mr. S. Grimwood that a donation of £73, being 10% of the amount available, be agreed.  All in favour.

 Mr. L. Smith and Mr. S. Powell returned to the meeting.

80/15 MEMBERS ITEMS

(a) Financial Information (Mr. G. Rees)

Mr. Rees proposed that the Members are presented with more detailed financial information which showed expenditure in year to date on particular subject headings and outstanding amounts.  That way the Members would know what had been spend and have a better knowledge to estimate future costs.  It was stressed that this was not a criticism of the existing procedure.  A discussion ensued and Members felt that, although they were supportive of the proposal, they did not wish to increase the workload of the Clerk, or incur costs to the Council.

It was, therefore, agreed that the Clerk contact One Voice Wales to enquire whether they had a system at a reasonable cost or knew of any Council that could assist.

(b) Pritchard Recreation Ground

It was reported that Mr. Tony Price and Mr. A. Mills had kindly supplied and spread wood chips in the area and it was agreed that letters of thanks be forwarded to both persons.

81/15 PRECEPT ESTIMATES FOR 2016/2017

 Draft Precept Estimates were received and discussed.  The Clerk explained that it had not been possible to provide more detailed estimates as the actual costs for some headings were awaited.  However, the following observations were made:-

 Increase contribution to Llanyre Church/Community Hall from £1000 to £2000
 Increase Llanyre Playing Field from £550 to £1550
 Remove grass cutting in Newbridge-on-Wye and Llanyre
 Add election costs and obtain a costing from PCC
 Add repair costs of £500 for play equipment in Llanyre
 Repair of Fountain on Village Green – Cllr. W. J. Evans to obtain a price

82/15 DELEGATION TO CHAIRMAN AND CLERK

 During the continued absence of the Vice-Chairman it was agreed that the Clerk in consultation with the Chairman be authorised to make decisions and incur costs up to a maximum of £100.  Any other urgent matters, or greater expenditure, would require an extra ordinary meeting to be called.

83/15 DATE OF NEXT MEETING

 The date of the next meeting was confirmed as Tuesday 19th January, 2016 at 7.00 p.m.
