A meeting of Cyngor Cymuned Llan Llyr/Llanyre Community Council was held at Llanyre Church Hall on Tuesday, 4th August, 2015.
Present:- Councillor S. Powell  (Chairman);
 Councillors Mrs. P. Abbott, M. Davies, Mrs. T. Field, S. Grimwood,
   G. Rees, L. Smith and M. Watkins.
 In attendance:- County Councillor W. J. Evans
 Apologies for absence were received from Mrs. P. Deakin and Mr. S. Meredith.
 There were none.
 The Chairman was authorised to sign as a correct record the Minutes of the meeting held on 16th June and of the extra ordinary meeting held on 30th June, 2015, subject to the following corrections on the minutes of 30th June:-
 Minute Ref. 30/15 – Request for Financial Assistant – add “All in favour”
 Minute Ref. 31/15(9) – Delete “8, Lon yr Afon” insert “9, Clos y Berllan”
(a) New A470/Traffic Calming Measures/By-pass (Ref. Min. 21/15(a))
It was reported that the flashing 30mph signs had not yet arrived.  With regard to the speed awareness meeting on 30th June, no update had been received as yet.
(b) Public Toilets, Llanyre (Ref. Min. 21/15(b))
It was reported that the downpipe has come away from the troughing.

Newbridge-on-Wye – the Clerk reported receipt of a request from the PTA that an alternative site for the bins be sought as the School is short of car parking space.  It was agreed that the Newbridge Members investigate the possibility of alternative sites and report back to the next meeting.

(e) Mid Wales House – Parking (Ref. Min. 21/15(e))
Correspondence was received from Mr. A. Knox confirming that Mr. S. Meredith had provided him with a lot of background information of the area but, to date, he had not been able to allocate time to review all of this and complete a report for the legal team to consider.  He hoped that it could be completed this Autumn.
(f) Proposed Llanyre Church/Community Hall (Ref. Min. 21/15(f))
The Clerk reported receipt of correspondence from the Charity Commission as follows:-
Thank you for your email regarding the Llanyre Recreation Ground.  Please accept my apologies for the delay in providing you with a response, however we did not receive your original email of 14 May.
Whether or not the trustees have the power to let the land for grazing, depends on which parcel of land it relates to.  The scheme of 2002 which governs the charity distinguishes between 2 parcels of land (schedule 1 and schedule 2 of the scheme).  The trustee has the power to lease a small part of the land identified in schedule 2 of the scheme and there is no restriction on what purpose it has to be let for. The trustee would need to comply with the requirements of the Charities Act 2011 which would involve getting a surveyors report and securing the best terms available for the lease. If this isn’t possible then we could consider making an order to allow the lease to go ahead but we would need to be satisfied that it was in the best interests of the charity.
If the land in question forms part of the land identified in schedule 1 there is no power to lease it and grazing would not be consistent with the objects of the charity as it is difficult to see how it could still be used as a recreation ground during those periods.
In order to provide a more definitive response we would therefore need more details of the arrangements.  However I would suggest that the trustees take their own professional advice before proceeding.
Members felt that it was in order to proceed with the letting and the Clerk agreed to forward the correspondence to those Members with e-mail addresses.
(g) Proposed New Crèche Facility (Ref. Min. 21/15(g)
It was reported that planning permission for the project had now been granted.
(h) Newbridge-on-Wye Recreation Ground (Ref. Min. 21/15(h))
The Clerk reported receipt of correspondence from the County Council which stated that the area of land to be transferred to the Community Council had now been re-considered and it was proposed that the whole area, including the tarmacademed car park area, would now be transferred.  It was noted that at the time of transfer from the Community Council to the County Council the owner of the adjoining property had paid a substantial amount for an access to the rear of the property and it was the understanding that this money was to be used to re-surface the car park area.  This work had not been carried out.  It was, therefore, agreed to accept the revised proposal for the transfer of land but an enquiry regarding the resurfacing be made.
Councillor Evans reported that he had been in discussion with the Portfolio Holder regarding the transfer of responsibility for the play equipment safety checks and it had been agreed that the County Council Officers could continue to undertake this work but no costings had been received to date.
(i) Llanyre Playing Field (Ref. Min. 31/15(5))

(j) War Memorial, Llanyre (Ref. Min. 31/15(1))
The Clerk reported receipt of a verbal quotation from B. Lloyd and Son in the sum of £375.  In view of the fact that there was no grant funding available to undertake the refurbishment it was agreed to defer a decision on the matter until the December meeting when the precept for the next financial year would be considered.
Mr. Watkins reported that he had examined the fencing at the front and it was noted that the left side is solid but the right side is loose.  Mr. M. Davies and Councillor J. Evans will investigate further.
(k) Pritchard Recreation Ground (Ref. Min. 31/15(2)
It was reported that Mrs. Smith would appreciate it if the bench could be repaired.  Mr. L. Smith and Mr. S. Powell agreed to make the necessary repairs and to contact Mr. G. Lewis for his assistance.
(l) Parking (Ref. Min. 31/15(3))
The Clerk reported receipt of copy correspondence between Mrs. G. Mills and Councillor W. J. Evans in which it was noted that the double yellow lines in front of the Bell Inn had not been re-instated following re-surfacing works.  It was agreed that these would be re-instated in August.  However, the double yellow lines around the outside of the Open Space had not been laid at all.  It was, therefore, not possible to re-lay what it would appear had not been installed in the first place.  Any additional lines across the front of the Open Space could be included in a future parking review for Llanyre.
(m) 9, Clos y Berllan, Newbridge-on-Wye (Ref. Min. 31/15(9))
It was reported that the Highways Department had no objection to the opening that had been installed in the new fence but it was advised that the Council clarify whether there was a condition of planning when approval was initially given.
 P/2015/0614 – Reserved Matters – for erection of dwelling and improvement to existing access to plot at Plot to South of Highbury, Llanyre, Llandrindod Wells.
 It was proposed by Mr. M. Watkins and seconded by Mr. M. Davies that the application be approved.  All in favour.
 The monthly balance of income and expenditure was received and approved.

A letter of thanks for the donation from the Recycling Funds was received and noted.
(c) Newbridge-on-Wye Post Office
Correspondence was received outlining the proposed changes to the Post Office.
(d) Scottish Power
Details of the renewal of the business contract were received and noted.
 A report of the One Voice Wales Brecon and Radnor Committee, prepared by Mr. M. Watkins was received and noted.  Copy filed with the signed minutes.
 The date of the next meeting was confirmed as Tuesday, 15th September, 2015.
There being no other business the Chairman closed the meeting at 8.45 p.m.
The Members discussed the following item in their capacity as Custodial Trustees:-
(a) Feedback from Gareth Jones -  Councillor Evans confirmed that he spoken with Mr. Jones who confirmed that the Insurance refund would be received in the near future.
(b) Invoice for Cleaning – an invoice in the sum of £192 for cleaning from January to May was received from Mr. P. Lewis.  It was agreed that it be passed for payment.
(c) Election Letting – the Clerk reported receipt of a BACS payment in the sum of £170 from Powys County Council.
